Acceptance of terms

By accessing or using LitigationPrep, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. These terms apply to all users including attorneys, paralegals, and other legal professionals.

Description of service

LitigationPrep is a litigation preparation platform that generates Expert Vulnerability Reports and provides cross-examination simulation tools for use by legal professionals. The service is intended to assist attorneys in preparing for litigation involving expert witness testimony.

Not legal advice

LitigationPrep is a litigation support tool. The output of the service, including Expert Vulnerability Reports and cross-examination questions, does not constitute legal advice. You are responsible for exercising independent professional judgment in how you use the information generated by the service. Nothing in our output should be relied upon as a substitute for qualified legal counsel.

Professional responsibility

Use of LitigationPrep is subject to the applicable rules of professional conduct in your jurisdiction. You are responsible for ensuring that your use of the service complies with your professional obligations, including those relating to competence, confidentiality, and supervision of nonlawyer assistance. We make no representation that use of this service is appropriate or permissible in all jurisdictions or practice contexts.

Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. You may not share your account with others or allow others to access the service through your credentials.

Acceptable use

You agree not to:

• Use the service for any unlawful purpose
• Submit false or misleading information
• Attempt to reverse engineer or extract the underlying AI models
• Resell or sublicense access to the service without written permission
• Use the service to generate content intended to harass, defame, or harm any individual

Intellectual property

The LitigationPrep platform, including its design, code, and underlying methodology, is owned by Elider, LLC. Reports and simulator sessions generated through the service are owned by you, the user. You grant us a limited license to store and process your submitted information for the purpose of providing the service. You may opt out of storage for any EVR report or simulator session by selecting the 'Do not save' option before generating, in that case, no content is written to our database.

Disclaimer of warranties

LitigationPrep is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the output will be accurate, complete, or suitable for any particular purpose. The accuracy of AI-generated analysis depends on the quality and completeness of information you provide.

Limitation of liability

To the fullest extent permitted by law, Elider, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of LitigationPrep, including but not limited to any adverse litigation outcomes. Our total liability to you shall not exceed the amount you paid for the service in the three months preceding the claim.

Termination

We may suspend or terminate your access to the service at any time for violation of these terms. You may cancel your account at any time through your account settings or by contacting us at legal@litigationprep.app.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in Travis County, Texas.

Changes to terms

We may update these terms from time to time. We will provide notice of material changes by email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
